Terms and Conditions

1. Acceptance of Terms

By accessing or using CalCrunch (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Gaurav Dhungana ("I", "me", or "my").

2. Description of Service

CalCrunch is a personal nutrition tracking application that allows users to log food consumption using natural language, track macronutrients and micronutrients, view nutritional history, and receive AI-assisted food and nutrient estimates. The App is offered on a free and paid/freemium basis.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. Users under 18 should have parental or guardian consent.

4. Account Registration

• You must create an account to use the App. You agree to provide accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify me immediately at my first name+inthevalley (remove the `+`) at gmail if you suspect unauthorised use of your account.
• I reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription and Payments

The App is offered on a freemium basis. Certain features may require a paid subscription. The following terms apply to paid plans:

• Subscription fees are charged in advance on a recurring basis (monthly or annually, depending on the plan selected).
• Payments are processed by a third-party payment processor. I do not store your payment card details.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods unless required by applicable law.
• I reserve the right to change subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new price.

6. Acceptable Use

You agree not to use the App to:

• Violate any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the App or its infrastructure.
• Upload or transmit harmful, offensive, or illegal content.
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the App.
• Use the App in any manner that could damage, disable, or impair the service.
• Scrape, copy, or redistribute data from the App without prior written permission.

7. Medical and Nutritional Disclaimer

IMPORTANT: CalCrunch is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. The nutritional information provided by the App, including AI-generated estimates, is for informational and general wellness purposes only.

Nutritional values, especially those estimated by AI, may be approximate and may not reflect the actual nutritional content of the foods you consume. Always consult a qualified healthcare professional, registered dietitian, or nutritionist before making significant changes to your diet, especially if you have a medical condition.

I expressly disclaim all liability for any health outcomes arising from reliance on nutritional information provided by the App.

8. AI-Generated Content

The App uses OpenAI's API to estimate nutritional data for foods not found in the local catalog. You acknowledge that:

• AI-generated estimates are approximations and may contain errors.
• AI estimates are stored in your personal food catalog and may be reused for future log entries.
• I am not liable for inaccuracies in AI-generated nutritional data.

9. Intellectual Property

All content, design, code, and materials comprising the App, excluding user-generated content, are owned by or licensed to Gaurav Dhungana. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

You retain ownership of the content you submit to the App (food entries, photos, messages). By submitting content, you grant me a limited licence to store, process, and display that content solely for the purpose of providing the App's features to you.

10. Privacy

Your use of the App is also governed by my Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand my practices.

11. Third-Party Services

The App integrates with third-party services including Supabase, OpenAI, Google, and GitHub. Your use of those services is subject to their respective terms and policies. I am not responsible for the practices or content of third-party services.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. I DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAURAV DHUNGANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR HEALTH-RELATED DAMAGES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow limitation of liability for certain damages, my liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Gaurav Dhungana from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any applicable law.

15. Termination

I may suspend or terminate your access to the App at any time, with or without notice, for conduct that I believe violates these Terms or is harmful to other users, me, third parties, or the integrity of the App. Upon termination, your right to use the App immediately ceases.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nepal.

If you are located in the European Union, you may also have rights under EU consumer protection laws that cannot be waived by contract.

17. Changes to These Terms

I reserve the right to modify these Terms at any time. When I make material changes, I will update the Effective Date and, where practicable, notify you via email or an in-app notice. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Gaurav Dhungana regarding the App and supersede all prior agreements or understandings.
